Terms of Service

Aice.com.hk (hereafter "Site") is owned and operated by AICE Corporation and its members (hereafter "AICE"). Use of the content, services, and/or products (individually and/or collectively, hereafter "Materials") presented in any and all areas of this Site constitutes the User's agreement to abide by the following terms and conditions (hereafter "TOS") herein. If you (hereafter "User") do not agree with any of these terms, do not access or otherwise use this Site or any information contained therein. The failure of AICE to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision.

As various aspects of this Site are updated or discontinued, AICE may modify all or any part of the TOS from time to time without notice to the User. Changes shall be effective immediately. It is the sole responsibility of the User to check back often to be aware of the User's current rights and responsibilities. The User's continued use of this Site or of any of the Materials therein after changes to the TOS have been published constitutes the User's binding acceptance of the updated TOS. If at any time the TOS is no longer acceptable to the User, the User should immediately cease all use of this Site and of all the Materials contained therein.

General Use Restrictions

All Materials on this Site are provided "as is" and "as available" by AICE or its respective members, manufacturers, developers and vendors (the "Third Party Providers"), and are the copyrighted work of AICE and/or the Third Party Providers, as applicable. AICE does not make any warranties, promises or representations, whether express, implied, statutory or otherwise, in relation to this Site, including but not limited to, implied warranties or conditions of completeness, accuracy, Site availability, satisfactory quality and fitness for a particular purpose.

This Site is for the User's personal, noncommercial use, and the User may download Materials only onto one computer hard drive. Except as stated herein, User agrees that the User has no right, title or interest in or to the Materials. User must keep all copyright and other notices intact. User may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell the Materials obtained from this Site. In addition, the information may not be taken out of context or presented in an unfair, misleading or discriminatory manner.

User also agrees not to "frame" or "mirror" any Materials (including trademarks, logos, graphics or images), in whole or in part, contained on this Site on any other server without the advance written authorization of AICE. The limited license set forth herein terminates automatically, without notice to the User, if the User breaches any of these terms. Upon termination of this limited license, User agrees to immediately destroy any downloaded and printed Materials. Inquiries regarding all other uses of the Materials should be made to mike@aice.com.hk.

Limitation of Liability

Any Materials downloaded or otherwise obtained through AICE is done at the User's own discretion and risk. The User will be solely responsible for any potential damages to the User's computer system or loss of data that results from the User's download of any such Materials. Under no circumstances shall AICE be liable to the User or any other person or entity, under any theory, for any loss or damage of any kind caused by the User's reliance on information obtained through this Site, even if AICE has been previously advised of the possibility of such damage. It is the User's responsibility to evaluate the Materials available at this Site.

By using this Site, the User agrees that these limitations will apply to all Materials that may be available. In the event that applicable law does not allow the limitation or exclusion of liability or damages, the User agrees that in no event shall the total liability of AICE to the User for all damages, losses and causes of action of any kind exceed one thousand Hong Kong Dollars ($1,000 HKD). The User also agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of this Site and the Materials contained therein or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred.

As a condition of use of this Site, the User agrees to indemnify AICE from and against all liabilities, expenses (including attorney's fees) and damages arising out of claims resulting from the User's use of this Site, including without limitation any claims alleging facts that if true would constitute a breach of claims resulting by User of the TOS. If the User is dissatisfied with any AICE Materials or with the TOS, the User's sole and exclusive remedy is to discontinue using this Site. AICE reserves the right to assume, at its sole expense, the exclusive defense and control of any claim, action or other matter for with the User is required to indemnify AICE, and all negotiations for settlement or compromise thereof, and the User agrees to fully cooperate with AICE in the defense of any such claim, action, settlement or compromise negotiations, as requested by AICE.

Message Board

This Site makes message boards available to the User. As the message board is a public forum, any information disclosed therein becomes public information, and so care should be taken on what the User decides to reveal or post. As AICE does not control the content in the message board, AICE does not guarantee the accuracy, integrity, or quality of such content. The User is solely responsible for all content that he/she uploads, posts, emails or otherwise transmits via the AICE Site. User shall not transmit content or otherwise conduct or participate in any activities at this Site that, in the judgement of AICE, is likely to be prohibited by law in any applicable jurisdiction. AICE reserves the right to take action against such User if the TOS is violated, including refusing/deleting content or preserving content if required to do so by law or as reasonably determined useful to protect AICE and other Users.

Vendor List

While AICE takes great care in continually updating the vendor list, AICE does not guarantee the accessibility of the vendor contact information provided on this Site nor does AICE guarantee the reliability of said contact. As such, the vendor list provided herein is for information purposes only and it is the sole responsibility of the User to take responsibility of the User's interaction with all vendors provided on this Site.
